工伤赔偿和侵权赔偿竞合法律理由

现代社会是一个风险无处不在的社会,工伤事故就是其中的一种风险结果,如何对遭受工伤者进行救济是一个劳动保障法和侵权赔偿法共同关注的话题,工伤赔偿请求权和侵权民事赔偿请求权的竞合是处理工伤事故时常见的不足。研究工伤赔偿与侵权民事赔偿的竞合关系,对处理工伤赔偿纠纷有着较为现实的理论意义。文章共分为五个部分。本文第一部分从工伤赔偿的概念和工伤赔偿的历史沿革入手,为探讨工伤赔偿和侵权赔偿的竞合不足做一些铺垫。这一部分讲述了国际劳工组织的一系列关于工伤的规定,同时也根据国内的《工伤保险条例》、《社会保险法》讲述了我国关于工伤的法律规定。归纳出工伤是劳动者在从事职业活动或者与职业责任有关的活动时所遭受的事故伤害和职业病伤害。工伤定义包括两个方面的内容,即由工作引起并在工作过程中发生的事故伤害和职业病伤害;工伤赔偿是劳动者因工伤致残或死亡,造成暂行或永久丧失劳动能力时,劳动者及其家属有权根据法律从国家或者社会获得物质帮助的社会保险制度。文章第二部分对工伤赔偿和侵权赔偿的竞合作了浅析浅析。根据竞合理论,工伤赔偿请求权和侵权民事赔偿请求权是分别根据不同的法律规范而产生的请求权,遭受工伤损害的工人可以同时享有工伤赔偿请求权和侵权民事赔偿请求权。文章第三部分介绍了国外对工伤赔偿和侵权赔偿的竞合处理的四种模式,并对各种模式的利弊进行了浅析浅析。选择模式有利于遭受工伤损害的工人自主选择,但实际上选择的余地不大;双重模式对遭受工伤损害的工人最有利,但与工伤保险制度的初衷不符,遭受工伤损害的工人最终所获得的赔偿可能比其实际损失要多;取代模式有利于遭受工伤损害的工人及时获得赔偿,但赔偿的力度和范围没有侵权赔偿的力度和范围大;补充模式可以给遭受工伤损害的工人及时赔偿,还可以保留向加害者追偿以便弥补工伤赔偿与实际损失的差额,是比较合理的工伤赔偿模式。文章第四部分对我国关于工伤赔偿不足的立法进行了梳理,对当前立法的近况进行了评论。我国工伤赔偿立法经历了工伤保险单一赔偿模式、补偿赔偿模式和兼得赔偿模式三个历史阶段。立法位阶不一,不便适用。《工伤保险条例》和《社会保险法》没有把精神损害赔偿纳入到工伤赔偿的范围。文章第五本分是关于如何完善符合我国国情的工伤赔偿模式进行了试探性研究。根据不同情况,适用不同的赔偿模式。在无第三人侵权的情况下,对未参加工伤社会保险的企业职工,可以选择企业参照工伤保险待遇给予赔偿,也可以依照侵权赔偿处理。对参加工伤社会保险的企业,在企业对工伤事故的发生不存在过错时,适用取代模式,在企业对工伤事故的造成有重大过失的情况下,适用补充模式,除了获得工伤赔偿,还可以要求企业承担侵权责任,以补充实际遭受的损害。在有第三人侵权时,在第三人有过错的情况或依法律规定无过错时也承担侵权责任时,适用补充模式,首先由第三人来承担侵权赔偿责任,不足部分再由工伤社会保险基金补充赔偿,无法确定第三人或第三人无力承担侵权赔偿的,由工伤社会保险基金先行赔偿,工伤社会保险基金有权向第三人追偿,第三人依法不需要承担侵权责任的,由工伤社会保险基金赔偿。
