The contradictions and conflicts of various interest groups appear gradually, and the interest conflicts obviously intensify. Therefore, inevitably, some group emergencies, which he become the top issues that the contemporary China’s political and legal practice must confront, he appeared. This paper will be divided into four aspects as follows.The first part will be defined as what a group emergency is in the perspective of law. First, the author introduces the historical changes of the concept of the group emergency to help the readers make a comprehensive understanding. Then, the author gives a definition of the“group emergency”from the point of law. Third, in order to deepen the recognition of the legal status of the group emergency, the author will use the above statement to compare the group emergency with riots and group’s security incidents, which makes clear the legal attributes of the group emergency.The second part is going to explain the legal reasons for the rising of group emergencies and the problems occurring in the legal regulation. China is in the primary stage of administration according to law, so there exist cases like disobeying the law or the abuse of discretion in the law enforcement process. Such cases may lead to the dissatiaction of the people, which will result in group emergencies. Moreover, the unooth relief ways of citizens’rights and the poor recognition of the citizens’administration according to law will increase the possibility of the group emergencies.In the third part, the author analyses the related theories of the group emergencies and the practical judgments of the related law and concludes the reasonable points which can be beneficial to China.The fourth part explains how to optimize the weak points produced in the legal regulation of the group emergencies. First of all, the author suggests putting forward measures to improve it in the initial stage. Second, the author suggests putting forward measures from the point of the disposal process. At last, it is necessary to dispose the relevant responsible persons after the investigation and to conduct reliefs to the victims.
